PRIVACY AND PERSONAL DATA PROCESSING POLICY

The purpose of this Policy is to provide information on the processing of the personal data collected from Forum users, in compliance with Law No. 19.628 on the Protection of Private Life and the Right to the Protection of Private Life (Art. 19 No. 4 of the Constitution).

1. Personal Data Collected and Purpose

The Forum requires the collection and processing of certain personal data, which is strictly limited to what is necessary for the operation of the platform:

  • Email Address: This is the only requirement for registration. It is used for account activation (validation through express and informed consent), password recovery, and sending critical administrative communications.

  • Username (Nickname) and Password: The nickname is collected for the public identification of the user within the Forum. The password is stored encrypted to ensure the security and authentication of access to the account.

  • IP Address: This address is logged automatically for security and moderation purposes and to prevent abuse, such as detecting multiple registrations or investigating serious infringements.

  • Removal Request Data: When a person, whether or not a Forum user, requests the removal of content under Section IV of the Rules, the identification data and documents required therein are received. They are used exclusively to verify identity and process the request, are kept under restricted access and are not disclosed to the reported user.

The Forum guarantees that this data will be processed under the principles of confidentiality, security and for lawful purposes related to the operation of the platform, in accordance with current legislation, without prejudice to its disclosure to the competent authorities when they so require in accordance with the law.

2. Account Security and Confidentiality

  • The password chosen by the user is strictly personal and non-transferable.

  • The user undertakes NOT to share their password. The Forum is not responsible for any consequences arising from the voluntary or negligent disclosure of the password.

  • The Forum uses security mechanisms to protect the user's access data, including password encryption.

3. Use of Cookies and Tracking Technologies

This Forum uses session cookies to store minimal information on your computer. This is necessary solely to facilitate browsing and staying connected (e.g. remembering your nickname and session). These cookies are essential for the operation of the Forum and are not used to track your activity outside the platform or for marketing purposes.

4. Rights of the Personal Data Subject (Chilean ARCO Rights)

In accordance with Law No. 19.628, the personal data subject (the user) has the right to:

  • Access and Information: Request information about the personal data stored and the purpose of its processing.

  • Modification or Rectification: Request the correction or updating of their personal data if it is erroneous, incomplete or inaccurate.

  • Cancellation or Erasure: Request the deletion of their stored personal data when there is no legal basis for storing it or when it has expired.

  • Blocking: Request the temporary suspension of the processing of their personal data, in the cases established by law.

To exercise any of these rights, the user must send their request to legal@laestokada.cl from the email address registered to their account and confirm it by Private Message (PM) from the same account, which allows them to prove they are the account holder without requiring any other personal data. The request will be answered within the legal deadlines.

Exercising the right of cancellation entails the deletion of the email address and access data of the data subject and, since the email address is the only registration requirement, results in the deletion of the account. The IP address and associated logs will be retained on legal grounds, for as long as necessary for security purposes and to respond to requests from competent authorities. Posts made will remain on the Forum without association to the data subject, identified as posts by a deleted user, without prejudice to the data subject's right to request the removal of their own photographs or personal data (Section IV of the Rules).

5. Responsibility for Shared Information

The user understands that the main purpose of the Forum is the publication of content and public interaction.

  • The user is solely responsible for the information they choose to share publicly on the Forum (text, images, links, etc.).

  • Users are urged NOT to share sensitive or private information that they do not want to become public knowledge, such as phone numbers, personal addresses, intimate photographs, or credentials for external services.

  • Sharing personal data, images or intimate material of third parties without their authorization is prohibited, in accordance with Section III.A, item 5, of the Rules.

  • Persons affected by content published by users, whether or not they are Forum members, may request its removal in accordance with Section IV of the Rules.

6. Role of Administrators and Moderators

Administrators and Moderators are responsible for safeguarding the integrity of the community and enforcing the Rules and the law, including:

  1. Ensuring Privacy: Acting as custodians of the personal data collected (email addresses, IPs) and using it only for the purposes described.

  2. Enforcing the Rules: Applying the rules of conduct to ensure respectful treatment, proper use and order within the community.

  3. Forum Reliability: Working to maintain the security of the platform and ensuring that the information shared complies with the Rules.

  4. Legal Safeguards: Carrying out content moderation and removal protocols in the event of infringements of Law No. 19.628 (Privacy), Law No. 17.336 (Intellectual Property) and other Chilean regulations, including responding to removal requests, the ex officio removal of manifestly infringing content and keeping a log of requests, in accordance with Section IV of the Rules.
